OFFICE MEMORANDUM

 

 

Subject:- Parity in the matter of payment of pro-rata retirement benefits to the Government servants permanently absorbed in the Central public Sector Undertakings and Central Autonomous Bodies –Guidelines for exceptions to the immediate absorption principle –

 

A reference is invited to Department of Pension &P.W.’s O.M of even number dated 19.4.88 on the above subject.  Certain guidelines for seeking exemption in respect of identified posts from the general rule of appointment of Government servants in autonomous bodies only on immediate absorption basis were laid down.  The procedure to be followed pursuant to the above guidelines was that each autonomous body should seek exemption by making a self-contained reference to this Department.

 

2.            It has been observed that a large number of references are being received from autonomous bodies in this Department seeking exemption in respect of posts which do not qualify under the guidelines laid down.  There are a number of cases also where the general rule of “appointment only on immediate absorption basis” is violated and exemptions are sought belated/requesting for retrospective regularization.

 

3.            I has now been decided that in future if any autonomous body wishes to seek exemption from the general rule of immediate absorption in respect of any particular post or posts or in respect of the organisation as a whole, the proposal should be made by the autonomous body to the Administrative Ministry/Department concerned.  In the administratiave Ministry the proposals maybe scrutinised in accordance with the guidelines already laid down in the O.M. dated 19.4.88.  Only such proposals which have the approval of the Secretary of the administrative Ministry concerned may be referred to the Department of Pension &P.W., indicating the justification for granting such exemption.  The reference from the Ministry should indicate that the proposal has received the approval of the Secretary of the Ministry.

 

4.            The above instructions may please be circulated to all autonomous bodies coming within the purview of the Ministry.

 

5.            The Ministry of Home Affairs etc., may please bring these orders to the notice of all concerned including the autonomous bodies under their administrative control.
