The undersigned is directed to say that in terms of the provisions contained in Fundamental Rule 35, the Central Government may fix the pay of an officiating Government servant at an amount less than that admissible under the Fundamental Rules. Accordingly, orders have been issued from time to time indicating the circumstances and the extent to which provisions of F.R.35 would apply. This Department’s O.M No.18/26/86-Estt.(Pay.I) dated 29th July, 1987 lays down the ceilings based on the pay scales sanctioned by the Government on the recommendation of the Fourth Central Pay Commission The question of revising these ceilings consequent upon the revision of pay scales of the Central Government employees on the basis of the recommendations of the Fifth Central Pay commission has been considered by the Government and the President is pleased to decide that in cases of appointments on promotion in the normal time within the cadre but which are not on regular basis, the pay under F.R.35 shall be restricted so as not to exceed the basis pay in the revised scales by more than the amounts shown below:-

OFFICE MEMORANDUM

Subject :- Incentive for acquiring fresh higher qualifications.

The undersigned is directed to say that in pursuance of the recommendation made by the Fourth Central Pay Commission, the question of grant of incentive on acquiring higher qualifications was considered by the Government and a centralized committee constituted. The Ministries/Departments of Government of India were advised vide this Department’s O.M. of even number dated the 28th June, 1993 that from the financial year 1993-94, the present system of giving advance increments shall be replaced by grant of lump-sum amount as incentive. Policy guidelines were also provided to consider grant of lump-sum incentive for acquiring fresh qualifications for which presently there is no scheme for grant of advance increments. The Ministries/Departments were requested to review the existing schemes in the light of the aforesaid guidelines.

On the basis of information received from various Ministries/Departments, the matter was considered by the Government and the standardised scales of lump-sum incentives in respect of the existing increment based schemes were issued vide O.M. of even number dated 31st Jan. 1995.

The question of finalising fresh qualifications ( in addition to the ones which presently qualify for grant of this incentive ) which would merit grant of lump-sum incentive was considered by the centralised committee and after taking into account the recommendations made by the Fifth Central Pay Commission in Chapter 23of their supplementary report No.1., it has been decided to grant lump-sum incentive on acquiring fresh qualifications listed in the annexure. The grant of incentive in respect of these qualifications will be subject to fulfilment of the criteria laid down in this Department’s O.M. dated 28th June, 1993 referred to above. The incentive will not be available for the qualifications which are laid down as essential or desirable qualifications in the recruitment rules for the post. The quantum of incentive will be uniform for all posts irrespective of their classification or grade or the department. The incentive will not be admissible where the government servant is sponsored by the government or he avails of study leave for acquiring the qualification. The incentive would be given only for higher qualification acquired after induction into service and will not apply for the incentives now being given in the existing schemes for possession of higher qualification at an entry stage. No incentive would be admissible if an appointment is made in relaxation of the educational qualification. No incentive would be admissible if employee acquires the requisite qualification for such appointment at a later date. The acquisition of the qualification should be directly related to the functions of the post held by him/her or to the functions to be performed in the next higher post. There should be direct nexus between the functions of the post and the qualification acquired and that it should contribute to the efficiency of the government servant. The qualifications meriting grant of incentive should be recognised by the All India Council for Technical Education, Department of Electronics, Deemed University, University or recognised by the Government. No stepping up of pay shall be allowed in the case of juniors by virtue of drawing more pay under the scheme of advance increments.

The grant of incentive for the qualifications listed in the annexure may be considered by the administrative authorities in consultation with their integrated finance and necessary orders issued after ensuring that the criteria laid down above is fulfilled. The incentive will be admissible on acquiring these qualifications on or after the date of issue of these orders.

Should any of the Ministries/Departments consider the extension of the incentive scheme to qualifications other than those listed in the annexure necessary, this should be done only with the prior approval of this Department and the Ministry of Finance.

The Ministry of Agriculture and Cooperation etc. are requested to bring these instructions to the notice of all concerned. In so far as the persons working in the Indian Audit & Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

OFFICE MEMORANDUM

Subject :- Option of date for fixation of pay on promotion – regarding.

The undersigned is directed to invite a reference to the saving clause of F.R.22(I)(a)(1) on the subject mentioned above which provides that when a Central Govt. employee is promoted to next higher grade or post where pay has to be fixed under the provisions of F.R.22.I(a)(1), he may be given option for fixation of his pay as under:-

either his initial pay may be fixed in the higher post on the basis of F.R.22(I)(a)(1) straightaway without any further review on accrual of increment in the pay scale of the lower post, or

his pay on promotion may be fixed initially at the stage on a time scale of the new post above the pay in the lower post, which may be re-fixed on the basis of the provisions of F.R.22.I(a)(1) on the date of accrual of next increment in the scale the lower post.

References have been received from various Ministries/Departments regarding applicability of the above provisions in the cases of employees who had been promoted before the Ist January,1996 and who had exercised option as at (b) above, for fixation of their pay on promotion and in whose cases the date of next increments in the lower scales (both pre-revised and revised )fell on or after Ist January, 1996. The matter has been carefully examined and the President is pleased to decide as follows:-

On Ist January, 1996,the pay of such Govt. servants may be fixed in the promoted posts with reference to pay that had been fixed at the time of promotion initially at the stage on time scale of new post above the pay in the loser post or from which he has been promoted on regular basis. They will be allowed to draw that pay in the revised scales w.e.f. Ist January, 1996.

Their notional pay in the lower posts in the revised scales may be fixed as on Ist January, 1996 from the dates of accrual of the next increment in the revised scale in the lower post, their pay in the promoted post may be re-fixed on the basis of provisions of F.R.22.I(a)(1).

In the promoted post, they will draw their next increments on completion of one year from the date the pay was re-fixed under (ii) supra subject to the satisfaction of other conditions.

The question as to whether the Government servants promoted before Ist January, 1996 should be given another opportunity to give fresh option to get their pay fixed in the promoted post in view of the introduction of revised pay scales w.e.f. Ist January, 1996has also been considered and it has been decided that the employees promoted after 1.1.1995 but before Ist January, 1996 and whose date of next increment in the lower posts falls on or after Ist January, 1996 may be allowed another option to get their pay fixed in the promoted post under F.R.22.I(a)(1) either from the date of promotion or from the date of next increment in the lower post falling on or after Ist January, 1996.

Option in terms of para 3 shall be exercised within a period of three months in case of officers who have been promoted on or after Ist January, 1996 till the date of issue of these orders. In case of promotions after the date of issue of these orders, option shall be given within one month of the date of promotion. Option once exercised shall be final.

In so far as their application to the employees belonging to the Indian Audit and Accounts Department is concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Ministry of Finance etc. are requested to bring the above decision to the notice of all concerned

Dated the 5th July, 1999

OFFICE MEMORANDUM

Subject  :-      Minimum      benefit      on       promotion – Recommendations of the Vth Central Pay Commission – Regarding.

The Vth Central Pay Commission in para 22.43 of its Report has recommended that the rules governing fixation of pay on promotion may be amended to provide an addition of 3% of basic pay in the lower grade or one increment in the lower grade, whichever is higher, and then fixation at the next stage in the higher pay scale.

The Federations/Associations participating in the National Council (JCM) in their list of demands submitted to the Govt. on 2nd August, 1997 relating to various recommendations of the Pay Commission had, inter-alia, demanded that the minimum benefit on promotion should be 5% of the basic pay. These demands were discussed by a Group of Ministers with the Staff Side in a series of meetings and a negotiated settlement was reached. The agreed settlement provides that recommendation regarding minimum benefit on promotion is a new principle enunciated by the Vth Central Pay Commission and the same needs to be examined by the Govt. While considering this recommendation, the demand of Staff Side for minimum benefit of 5% of basic pay in the lower post will be kept in view.

The matter has since been examined. A liberal package has already been extended to the employees on the recommendations of the Vth Central Pay Commission as further improved upon in regard to pay scales/ fitment formula, etc. Keeping this in view and considering the substantial financial implications involved in accepting the recommendation regarding minimum benefit on promotion, it has been decided not to accept the recommendation of the Pay Commission in para 22.43 of its report as sought to be improved upon by the Staff Side.

As per the existing provisions of F.R.22.(I) (a)(1), on promotion to a post carrying duties and responsibilities of greater importance, the initial pay of a Govt. servant in the time scale of the higher post is fixed at the stage next above the notional pay arrived at by increasing his pay in the lower post held by him regularly by one increment at the stage on which such pay is accrued or Rs. 25 only, whichever is more. Consequent upon revision of the pay scales of the Govt. servants on the recommendations of the Pay Commission, the quantum of Rs.25, referred to in F.R.22(I)(a)(1) has been reviewed and it has been decided to raise this amount to Rs.100/- so as to ensure that every employee is assured of a minimum raise in pay of Rs.100/- on promotion.

These orders take effect from the date of issue.

Formal amendment to F.R.22 (I) (a)(1) is being carried out separately.

Insofar as persons serving in Indian Audit and Accounts Department are concerned, these orders issue in consultation with Comptroller and Auditor General of India.

Hindi version is enclosed.

While applying the above principle the following method may be adopted.
