Restoration of one-third commuted portion of pension after 15 years from the date of commutation in respect of the Government servants who had drawn lumpsum amount on their absorption in a Public Sector Undertaking/Autonomous Body – implementation of the Judgement of the Supreme Court -

The undersigned is directed to refer to this Department’s O.M.No.4/3/86-P&PW(D) dated 30.9.96 on the subject cited above and to say that clarifications have been sought by Ministries/Departments regarding applicability of the provisions of the O.M. dated 30.9.96 to Government servants who have been absorbed in a Central PSU/Central Autonomous Body as a result of conversion of a Government office/Department as such.
2. The matter has been carefully examined. It is clarified that the provisions of this Department’s O.M. No.4/3/86-P&PW(D) dated 30.9.96 are also applicable to the Central Government employees who have been absorbed in a Central PSU/Autonomous Body as a result of conversion of a Government Office/Department as such.
3. This issues with the concurrence of the Ministry of Finance (Department of Expenditure) communicated vide their U.O.No.292/EV/97 dated 24.4.97.
