OFFICE MEMORANDUM

 

Subject:  Implementation of the recommendation of the Vth CPC regarding conversion of 50% Dearness Relief into Dearness Pension – clarification regarding.

The undersigned is directed to say that a number of communications have been received from various Ministries/Department/Pay & Accounts Offices seeking clarification regarding conversion of 50% Dearness Relief into Dearness Pension in terms of this Department’s O.M. No.42/2/2004-P&PW(G) dated 15th March, 2004.  The points raised are clarified below:-

Decision/Clarification

(1)  Whether minimum pension of Rs.1,275/- has been enhanced to Rs.1913/-?  Should this amount be mentioned in PPO?

 

No.  Minimum basic pension continues to be Rs.1275/-. However those who retired on/after 1.4.2004 would be entitled to minimum pension/family pension of Rs 1275/- plus Dearness Pension amounting to Rs 638/- which comes to 1913/-  Since there is no change in the limit of minimum pension there is no need to revise the limit of minimum pension in the PPOs.

 

 

(2)  Whether re-employed/absorbees are eligible of Dearness Pension?

No.  Since they are not eligible for Dearness Relief, the question of conversion of 50% DR into Dearness Pension does not arise.

 

(3)  Whether pension should not be less than 50% of the minimum of scale of post or 50% of the minimum of scale plus Dearness Pay of the post?

Since Dearness Pay is included in emoluments for calculation of pension, 50% of minimum of scale will also include Dearness Pay.  However Dearness Pay and Dearness Pension will be shown distinctly from the minimum of scale.

 

(4)   Whether recovery of License Fee under Rule 72(6) can be made from Dearness Pension also?

 

No. Extant rule continues and License Fee will be recovered from DR only.

            In this Department’s O.M. No.45/1/2004-P&PW(G) dated 27th January, 2005, on the subject mentioned above, the date mentioned in line 4 of clarification No.1, as `1.1.2004’ may be substituted as `1.4.2004.’

 

2.         In point 2, the words `if not entitled for Dearness Relief on their pension’ may be added after `whether re-employed/absorbees are eligible for Dearness Pension?’
